Welcome to the RapidTesting Miami website (the “Site”), operated by RTM, LLC (“RTM,” “we,” “us”). By using the Site or any of our services — including our clinic finder, text messages, and referral services (the “Services”) — you agree to these Terms and Conditions. Please read them carefully. The Services are intended for adults 18 and older. People aged 13 to 17 may use the clinic finder to receive their nearby clinic results and to be connected with a clinic, because Florida law allows minors to consent to STD testing and treatment; the “Offers and updates” and “Research opportunities” options are available only to adults 18 and older. The Services are not intended for children under 13.
RTM may modify these Terms at any time by posting the updated version on the Site with a new “Last updated” date. Changes take effect when posted. Your continued use of the Services after a change means you accept it. Changes to how we use information you already gave us will not reduce the choices you made under Section 6 without your consent.
Your use of the Services is also governed by our Privacy Policy, our HIPAA Notice of Privacy Practices, and our Messaging Terms & Consent Details, which are incorporated into these Terms by reference.
RTM helps people find nearby STD/HIV testing, PrEP and related health services, partner clinics, research studies and blood-donation sites. RTM does not provide medical care, diagnosis or treatment. Care is provided by independent clinics and providers who are solely responsible for the services they deliver. Clinic matches are based on the information you give us and public data (such as HRSA’s 340B registry) and may not be complete or current. The Services are not for emergencies — if you have a medical emergency, call 911. Some partner clinics and research facilities pay RTM for featured placement, referrals or promotions.
Program: RapidTesting Miami Clinic Finder. When you request clinic results, you agree to receive a one-time verification code and a text message with your nearby clinics (usually 2 messages per request). If you separately opt in (Section 6), you may also receive recurring marketing and promotional text messages, calls (including those made with automated technology or a prerecorded/artificial voice) and emails. Message frequency varies (marketing typically up to 4 per month). Consent to marketing is not a condition of any purchase or service. Message and data rates may apply. Reply STOP to cancel or HELP for help, or call 855-560-2280. Carriers are not liable for delayed or undelivered messages. We do not sell your phone number or share mobile numbers or text-messaging opt-in data with third parties for their own marketing.
Our forms offer separate, optional choices that are unchecked by default. Declining them never affects your clinic results or access to any service:
You can withdraw any of these choices at any time by replying STOP to a text, using the unsubscribe link in an email, or writing to privacy@rapidtestingmiami.com. Withdrawal does not affect information already shared in reliance on your consent.
You agree to comply with all applicable laws when using the Services. You represent that the information you provide to RTM — including your phone number and email — is truthful, accurate, current and belongs to you.
You agree to indemnify, defend and hold RTM and its partners, employees, affiliates and agents harmless from any liabilities, losses, claims or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of the Services.
RTM may suspend or end your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.
Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and RTM.
These Terms, together with the documents listed in Section 3, are the entire agreement between you and RTM regarding the Services and supersede any prior agreements, communications or proposals.
a. Informal negotiation. In the event of a dispute, you and RTM agree to first try in good faith to resolve it informally. The claiming party must send the other a written Notice of Dispute that includes its name, address and contact information, facts sufficient to evaluate the claim, and the specific relief sought.
b. Binding individual arbitration. If the dispute is not resolved informally within a reasonable period, you and RTM agree that any dispute, controversy or claim arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration on an individual basis only. Class actions and representative claims are not permitted.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
To the fullest extent permitted by law, RTM disclaims all liability for any losses or damages — direct, indirect, incidental, special, punitive or consequential — arising from your use of the Site or the Services, including any care you receive from a clinic or provider you find through the Services, even if RTM has been advised of the possibility of such damages.
If any provision of these Terms is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the rest of these Terms will remain in full force and effect.
